Where for art thou, FLO?

The adventures of the Finding the Law Project continue!  So it’s time for another update from the Project Lead, Anastasia Stepanovic, and Project Coordinator, Alice Hewitt. Our last update on the ALLA (WA) Blog was back in June – and since then we have presented at the ALLA (WA) Conference, published articles in the Australian Law Librarian journal, and we’ve gained a lot of ALLA member feedback and suggestions – end even a few new members to the project team.  At the ALLA Conference 2022 in Hobart, Anastasia and Alice presented a paper paying respect and homage to the evolution of Finding the Law – including all its various names, formats, and teachers. The presentation was centred around where ALLA had began this sort of law librarianship skills training, the different names the course was titled over time, and the different divisions that took the lead over time. Uncommenced provisions in Western Australian legislation update

New information up on the Western Australian Legislation website [www.legislation.wa.gov.au] ... Provisions not yet in force There has been a change to the way uncommenced provisions (including uncommenced amendments) in WA legislation are shown on this website . The changes have been made in response to feedback that the way uncommenced amendments have been shown may not make it clear enough that the amendments have not in fact commenced. Principal legislation with uncommenced provisions In the case of principal legislation, past practice was to indicate in the body of the legislation that certain provisions have not come into operation, and include in a note to the legislation the text of the uncommenced provisions. The text of the uncommenced provisions is no longer included in a note. Instead an “Uncommenced provisions table” is included that lists the uncommenced provisions and where they can be viewed. New look DoJ Law Library website now live

The new look of the Department of Justice's Law Library website went live today: https://dojwa.ent.sirsidynix. net.au/client/en_AU/llwa The  link is also available on the  Department’s website . The website includes links to free resources where available, as well as the library catalogue. Services marked with a padlock symbol are only accessible from onsite within the library.

Time to update your bookmarks - State Law Publisher WA URL change

On Friday March 16 th the Parliamentary Counsel’s Office took over the hosting of the WA legislation website from the State Law Publisher. The new web address for WA legislation is now  www.legislation.wa.gov.au .   The website functionality is unchanged, but it is now badged as Department of Justice/Parliamentary Counsel’s Office rather than Department of Premier and Cabinet/State Law Publisher.

Open Access Law

Today marks the start of Open Access Week . With that in mind, here's a blog post from Cornell University Law Schools VoxPopuLII Blog - home of the Legal Information Insitute [LII] which has been providing open access to American law since 1992. (Those familiar with our own AustLII would see the relationship here). Catalogue for the new Law Library

The Department of the Attorney General has updated their website so that it now includes the library catalogue of the Law Library at the David Malcolm Justice Centre. You can access the library catalogue here . The Law Library at the David Malcolm Justice Centre is at 28 Barrack Street and is open Monday to Friday from 8.30am - 5pm. It is closed on public holidays. The Library is for the judiciary, government legal officers and members of the legal profession, and so it is not open to the public.

Mining Law in WA write up

ALLA(WA) CPD session: An outline of types of litigation under the Mining Act 1978 (WA) and some recent cases (Presented by Anthony Papamatheos, Barrister at Francis Burt Chambers) This lunchtime CPD session was hosted at Francis Burt Chambers on Thursday 15th September and was attended by 13 members and 4 non-members. Anthony provided a short overview of the Mining Act 1978 (WA) and Mining Regulations 1981 (WA), including the types of land over which tenements are granted in WA, the types of tenements and their key features and obligations.  We were also provided with an overview of the application processes, how tenements may be forfeited or surrendered and how underlying land owners or occupiers can seek compensation for loss from mining.  The session concluded with Anthony discussing some recent cases paying homage to the benefit of strong attention to detail and the importance of point-in-time research in mining law. Historical Commonwealth Gazettes

In case you missed the announcement, copies of the  Commonwealth of Australia and Australian Government Gazettes from 1901 to 2012 are now online at the Federal Register of Legislation https://www.legislation.gov.au/Content/HistoricGazettes These historical gazettes are all in searchable PDF format. More recent Commonwealth Gazettes, from October 2012 onwards, can be found at this link https://www.legislation.gov.au/Browse/ByTitle/Gazettes/InForce/0/0/ These more modern gazettes are available as individual notices in a variety of formats. Thanks to the Office of Parliamentary Counsel, in conjunction with National Library of Australia and the Australian Government Solicitor Group in the Attorney Generals Department, for making this possible.

Law Library at the David Malcolm Justice Centre

Information below provided by the Department of the Attorney General: From 1 July 2016, the Law Library at the Supreme Court will close its doors and the Department of the Attorney General will provide library services to legal practitioners at the Law Library at the David Malcolm Justice Centre. Legal practitioners (and other persons doing research on behalf of legal practitioners) can access the Law Library by going to Level 23 of the David Malcolm Justice Centre, and will be given access to the Law Library (which is located on Level 2). The Law Library's opening hours will be 8.30am to 5pm Monday to Friday and services will include: - access to a browsing collection, with loans (other than loose leaf services) to take to court only; - reference desk services; - access to electronic databases at the Law Library (including LexisNexis, Westlaw and CCH) will be available from 25 July 2016; - photocopying and printing; and - document delivery. Ross Intelligence: a new way of looking at legal research
